There is a stench of fascism arising from the anti-immigrant, law-and-order measures being implemented by French President Nicolas Sarkozy. Policies and methods which people had hoped were forever left behind in the 1930s and 1940s are being revived by the European bourgeoisie in an attempt to deal with the consequences of the global economic crisis.
There is no clearer example than the mass deportations of Roma, a population once targeted for extermination by the Nazis. They and their collaborators killed between 250,000 and 500,000 Roma. The French collaborationist Vichy authorities raided Roma communities and held their inhabitants in concentration camps such as Jargeau, near Orléans.
While European governments do not yet encourage anti-Semitism, in part due to popular awareness of the Holocaust, they encourage and exploit anti-Roma hatred.
Other measures proposed by Sarkozy also borrow directly from the legal arsenal of fascism. Having moved to ban the burqa, the government aims to strip French citizenship from naturalized citizens who clash with the police. It is also threatening parents of juvenile delinquents with jail time if their children violate restrictions placed upon them by the justice system.
The last time France revoked citizens’ nationality for non-capital crimes was under the Vichy regime, which took away 7,000 Jews’ citizenship. Holding families criminally responsible for actions of their members, the Nazis’ Sippenhaft policy, has been condemned as barbaric since the collapse of the Third Reich.
While Roma and burqa-wearing women are first in the government’s line of fire, its ultimate target is opposition to austerity and war by the entire working class.
The government has looted the economy in the interests of the financial aristocracy. Having orchestrated a €360 billion handout to the banks and allegedly taken campaign contributions from billionaire Liliane Bettencourt while helping her evade taxes, Sarkozy is pressing ahead with pension and budget cuts. The press is also calling for France to boost its military spending, anticipating broader wars in the Middle East and Asia.
Sarkozy’s measures are a preparation to meet social opposition to these policies with violent repression. This is endorsed by the entire political establishment. The bourgeois “left’s” criticisms are largely from the right. The Socialist Party and its allies pose as more skilled administrators of the police than Sarkozy.
The particular measures Sarkozy is proposing suggest that he anticipates a clash with youth in impoverished suburban estates, largely populated by immigrant families. The government is preparing to respond with mass jailings and deportations. When such riots broke out in 2005, then-President Jacques Chirac imposed a three-month state of emergency. Sarkozy, as interior minister, demanded that foreigners participating in the riots be deported.
The situation is broadly similar in countries around the world. European governments have widely incited anti-Muslim sentiment, often under the guise of defending women’s rights. National burqa bans have passed or are under consideration in Belgium, France, Italy and Denmark, and by local authorities in Spain. Last year, a Swiss referendum banned the construction of minarets. The far-reaching, reactionary implications of such measures, which paved the way for the current right-wing campaign in France, are now becoming apparent.
In Italy, which is also deporting Roma, Interior Minister Roberto Maroni applauded Sarkozy’s measures and repeated a proposal to expel citizens of other European Union countries who cannot support themselves. This policy was previously struck down by the European Commission (EC). However, the EC now endorses Sarkozy’s far-right measures. EC spokesman Matthew Newman has stated that the commission does not consider the French government’s large-scale expulsions of Roma to meet the criteria for a “mass expulsion.”
In the United States, there is an ongoing legal battle over an Arizona state law allowing police to arrest anyone who fails to show documents proving he or she is not an “illegal” immigrant. The law, which would pave the way for mass deportations, including of legal immigrants, is the outcome of a decades-long promotion of xenophobia and chauvinism by forces within the Democratic as well as the Republican Party, and within the trade union bureaucracy.
Now the plan to build an Islamic community center two blocks from the World Trade Center buildings destroyed in the 9/11 attacks has become the occasion for a fascistic campaign against Muslims.
The bourgeoisie’s moves towards police-state rule are a serious warning to the working class. The defense of democratic rights as well as working class living standards is possible only through the independent mobilization of the working class in a struggle for workers’ power and socialism.
In this regard, the intervention in France’s 2002 presidential elections by the International Committee of the Fourth International (ICFI) is a critical experience. Unlike the Pabloite Ligue Communiste Révolutionnaire, which oriented its politics to a section of the ruling class, the ICFI has seen its positions thoroughly vindicated.
France’s 2002 presidential elections produced a second round run-off between Chirac and neo-fascist Front National candidate Jean-Marie Le Pen. As mass demonstrations spread throughout France, the ICFI called for a working class boycott of the election as the best means to fight for a break with all of the bourgeois parties and the development of an independent political movement of the working class. The LCR, instead, effectively backed Chirac, calling for a vote “against Le Pen” as the only way to halt the slide towards fascism.
This perspective of an alliance with a section of the ruling class against neo-fascism has proven completely bankrupt. The LCR’s support helped give Chirac’s Gaullist party a progressive veneer, paving the way for Chirac, and then Sarkozy, to impose a series of social cuts against the workers, with the tacit support of the trade unions and the bourgeois “left.” Now, as Sarkozy seeks to deepen his attacks, he is adopting the very policies advocated by Le Pen which, the LCR claimed, a vote for the Gaullists would prevent.
Now matter when we look at mankinds journey through history we always see the rich and powerful, wether it's military dictators & juntas, or Plutocratic Corporatocracies oppressing the populace, the common folk.
It seems that if somebody is wealthy or absolute powerful they see a need to conquer, exploit, fleece, oppress or outright exterminate the average working Joes and Janes.
What have the masses ever done to the super elite to warrant this type of treatement?
Why must rights and privilidges be exclusive to the elite as they attempt to limit or eliminate rights, privilidges, liberties and democracy for the masses?

Why must there be a social food chain with the wealthiest feeding on the less fortunate and the masses in general?

On Thursday, in a deliberately high-profile attack on the Roma community, the French government deported 93 Roma gypsies to Romania, their country of origin, in two flights from Paris and Lyon. A further flight with 100 deportees was due to leave on Friday and another on August 26.
Interior Minister Brice Hortefeux claims that 700 Roma will be deported by the end of August. He bragged on Tuesday that 51 Roma camps had been dismantled over the last three weeks, out of a target of 300. The authorities display brutal unconcern for the suffering inflicted on these families, who face systematic persecution, poverty, unemployment and lack of access to social services. In an event that caused widespread outrage, the police, when evicting Roma families from a squat in the Paris suburb of Montreuil, separated the men from the women. They then threatened to take the children from the women if they did not submit.
President Nicolas Sarkozy and his ministers are seizing on the riots provoked by the July 17 police killing of Roma youth Luigi Dequenet, at a police checkpoint in the village of Saint Aignan, to appeal to racism and escalate anti-Roma repression. As Sarkozy moves to deport large numbers of Roma, he is pressing ahead with further attacks on immigrants’ rights, paving the way for the massive police violence. In a July 30 speech in Grenoble, Sarkozy demanded that the government have the power to strip convicted immigrants of their nationality. This flies in the face of the constitution and European laws guaranteeing equality of citizenship rights, regardless of ethnic origins. The pretext for this speech was the police killing of Karim Boudouda near Grenoble, the day before Dequenet’s death.
By giving full support to these police killings and the subsequent use by the police of live rounds against protests in Grenoble the government is sending an unmistakable signal to the police forces that they can fire on the population at will. Sarkozy is playing the racist and law-and-order cards to the full, in a desperate attempt to fashion a shaky national consensus for the right-wing policies he has adopted, notably in the aftermath of the financial crisis. He is deeply unpopular due to his repeated social cuts against the working class, and compromised by allegations his party accepted funding from billionaire Liliane Bettencourt while helping her evade taxes. His main foreign policy initiatives, notably the war in Afghanistan, are also overwhelmingly unpopular.
In France and abroad, the press widely notes that these measures help distract attention from Sarkozy’s unpopular policies. The German news magazine Der Spiegel wrote: “Paris has seemed intent on using the expulsions as a political tool. Comments of the kind made by Hortefeux and [Minister of Industry Christian] Estrosi are useful for producing headlines.” Estrosi has called for €30,000 fines and two-year prison sentence for parents of delinquent children. Ministers have attacked the Roma with racist slanders. Immigrant support group France Terre d’Asile notes that Hortefeux’ claims that Roma camps are “hotbeds of illegal trafficking, the exploitation of children for begging, prostitution or crime” are not “backed up ... by facts and figures or examples.” It added, “Such things are marginal.”
“The Roma are being made scapegoats,” said Maria Ochoa Llido, head of the Migration and Roma department of the Council of Europe. She said the real problem is that France had failed to implement its own law requiring municipalities of 5,000 people or more to provide sites equipped for travellers. Unlike in other European countries, Roma will not have the right to work in France before 2014.
Hysterical anti-Roma propaganda is being used to accelerate ongoing police operations. Last year 10,000 Roma were deported to Romania or Bulgaria on 44 flights, of which 30 percent were forced repatriations, according to the ministry. Thursday’s two flights to Romania were the 25th and 26th this year. In 2009 nearly 11,000 were repatriated, “an increase of more than 20 percent in relation to 2008,” according to the French Office of Immigration and Integration.
Government claims that the deportations, with the flights paid for by the state and €300 provided for each adult and €100 for each child, are voluntary. This is disputed by Roma advocates. According to the Associated Press, they said “the repatriations were hardly voluntary, and that those who refused the offer would end up in holding centres and be sent back and eventually be sent home without funds.” The Council of Europe estimates that two thirds of Roma that have been sent back to Bucharest with financial incentives return to France. The government has announced the September 1 launch of a biometric database, dubbed Oscar, to store the fingerprints of people who undergo “assisted repatriations.” Authorities will then prevent them from receiving more assisted repatriations.
The Roma, as citizens of EU countries, have the right to circulate within the EU. However, French law requires them to have a work permit, which is virtually impossible for them to obtain, and to prove that they have the means to support themselves if they intend to stay for more than three months. There are an estimated 10 million to 12 million Roma, citizens of countries throughout Europe and beyond. Many face discrimination and high unemployment; those deported from France do not expect to find jobs in Romania or Bulgaria.
Roma have lived in France since the 15th century. With the abolition of Roma slavery in the 19th century in Moldavia, Walachia and Transylvania, the Roma Diaspora spread throughout Europe. In France there are 400,000 Roma, mostly enjoying French nationality, living in flats and practicing professions. Many are also itinerant traders relying on specially provided camps. However, because of inadequate provision, they often have to set up camp on unofficial sites.
Between 12,000 and 15,000 Roma, citizens of Romania and Bulgaria, have legally come to France since their countries joined the European Union in 2007. According to the BBC, 10 other EU countries, including Germany, Italy, Denmark and Sweden, which also welcomed Roma, are also adopting a deportation policy. Transitory measures adopted by some 10 states, including France, limit access to work and residence rights for Romanian and Bulgarian migrants until December 12, 2013, when the restrictions will end.
The Roma communities in Bulgaria and Romania count some 750,000 and 2 million people respectively, of which a tiny proportion have emigrated to other EU countries since accession. Le Monde asserts that there are 22,000 in Belgium and probably more than that in Italy and Germany. There is no serious opposition being mounted by the Socialist Party, other forces on the bourgeois “left,” or the unions to the ominous turn of a government developing proto-fascist policies.
The Socialist Party and the Communist Party, while criticising Sarkozy’s assertion that the immigrants are the cause of criminality, attack him from the right for not repressing the youth and the ghettos vigorously enough. Martine Aubry, mayor of Lille and first secretary of the PS, has praised the 4,000 surveillance cameras with which she has endowed her city as an example of her devotion to law and order.

The goal of the government is hardly the deportation of the hundreds of thousands of immigrant workers who sweat and die in textile and metalworking factories, in the fields, construction sites, hospitals and homes to enrich the “Made in Italy” billionaires. The “security package” is used to isolate and terrorize immigrants, to bind them hand and foot to their exploiters, in order to further divide the working class. It also serves to strengthen state surveillance and repression: some 2,500 soldiers will be deployed in major cities to intimidate all workers, at the very moment when the Confindustria [the bosses’ cartel] and the government are preparing an offensive against national wage contracts, planning thousands of layoffs (at Telecom and Alitalia) and trampling on public employees, who are denounced en masse as “lazy bums.”
The attacks by the state and the racist gangs against immigrants represent an attack on the entire working class. 700,000 immigrant workers are already members of the CGIL, CISL and UIL trade-union federations (a very high percentage considering that many work in small, non-union companies), and their participation in working-class mobilizations is growing. The defense of immigrants is therefore not only a question of defending democratic rights, but also defense of the entire working class. What is needed is an immediate mobilization of union power, supported by all potential victims of racist terror, in class-struggle actions to stop deportations and racist attacks against Roma, Sinti and immigrants. Just before the start of the official summer holidays, the French government headed by President Nicolas Sarkozy made yet another significant move to the right. It linked the issue of domestic security with ongoing racist attacks against Roma and immigrants, thereby adopting the line followed by the extreme right-wing National Front (FN). Marine Le Pen, the FN’s vice-president, reveled in the fact that the head of state had confirmed the perspective held by her party for the last 30 years.
During a speech in Grenoble on July 30, celebrating the appointment of the new superintendent of the Isère administrative district, Sarkozy set out the main tenets of the new course, which had been backed by the whole government two days before. According to this, all the camps of nomadic Roma are to be dismantled, penalties will be leveled against whole families rather than individuals, and criminalized French citizens with a migrant background will have their citizenship revoked.
As direct pretext for these moves, Sarkozy drew upon the disturbances that had broken out two weeks earlier in Villeneuve, a Grenoble suburb in the Isère district, and Saint-Aignan in central France, after police shot two young men in residential areas. The new measures, however, are completely in line with previous provocations, through which the government fanned racial tensions and boosted the repressive machinery of the state. Only last month, the National Assembly passed a law that made Islamic women wearing veils liable to draconian penalties—a gross violation of fundamental democratic principles.
Critical commentators regard the government’s maneuvering primarily as a reaction to Sarkozy’s political difficulties. The president is deeply mired in the Woerth-Bettencourt financial scandal and is trying to divert attention from suspicions of illegal party financing. At the same time, he is fishing in the murky waters of right-wing extremism, in an attempt to improve his prospects for the presidential election in 2012. In this respect, Sarkozy is drawing on his experience as interior minister from 2002 to 2004. By upgrading the apparatus of the state, it is preparing repressive measures aimed not only at Roma, Muslims and other minorities, but the working class as a whole.
Sarkozy’s speech in Grenoble bristled with military rhetoric. The president announced that he would “wage war” against drug pushers and criminals. Alluding to the administrative department of the new superintendent, Eric Le Douaron, he added that, “In this department and in this city (Grenoble), no housing estate, no street, no stairwell, no row of houses will find itself beyond the rule of the Republic. This is now your task.” He announced that the Department of Isère would be equipped with a large number of police cars and police officers expressly for night duty. By 2012, as many as 60,000 surveillance cameras would be installed there.
The president welcomed the prospect of parliament dealing with the introduction of harsher punishments for cases of serious violence, as soon as the holidays were over. “In particular, I want judges to be able to automatically sentence re-offenders to wearing electronic tags, years after serving their time,” he said.
He went on to say that he would commit himself to upholding the integrity of French citizenship and that, “It must be possible to cancel the French citizenship of all those people of foreign descent, who wilfully inflict damage on the life of a police officer, a soldier or any other person of public authority. French citizenship is a reward, for which one must prove oneself worthy.”
Sarkozy’s interior minister, Brice Hortefeux (UMP—Union for a Popular Movement) also recently used the Le Parisien newspaper to call for the withdrawal of French citizenship for certain offences—for example, in cases of female circumcision “or other serious crimes”.
Immigration Minister Eric Besson, responsible for drafting of the appropriate legislation, explained in Le Figaro that he wants to deny French citizenship to French-born youths, who “force their wives to wear full-face veils, refuse to shake hands with female officials, or fail to accept the principle of secularism or non-clerical government.”
The practice of revoking citizenship harks back to the Vichy regime that ruled France during the Nazi occupation. At the time, naturalised French people of the Jewish faith were the main targets: people like the painter Marc Chagall and the family of cabaret singer Serge Gainsbourg. Since then, it has been possible only on very rare occasions to revoke French citizenship. According to the immigration minister, there were only five such cases prior to 2006, on charges such as treason or terrorism.
Sarkozy’s speech also promoted the principle of penalising the whole family of someone who commits a crime. He said that, “The issue of parental responsibility is clearly evident”, and he threatened to punish parents, who allow their children to miss school, by cutting their child allowance payments.
The UMP delegate, Eric Ciotti, is preparing a new law that threatens fathers or mothers with up to 2 years imprisonment and a €30,000 fine, if they allow their underage, previously-convicted children to overstep the strict conditions and restrictions. Such methods are reminder of the “Sippenhaft” tactics of the National Socialists, whereby punishment for the deeds of a presumed perpetrator was made to be borne by his or her whole family.
Children are to increasingly face incarceration in prisons or boot camps. To accomplish this, the government intends to redraft a law from 1945, relating to young offenders. According to Sarkozy, the 1945 legislation can “no longer be applied to today’s minors”. Ordinance Number 45-174 from 1945—which for a long time stressed the priority of parental rights over repressive tendencies of the state—had already been significantly toughened in 2002 with the establishment of correctional centres for young offenders.
Sarkozy announced in Grenoble that “about 20 facilities” would be opened after the holidays, which would “provide appropriately intensified supervision” that he described as “educational rehabilitation”. He warned that “the behaviour of certain young people, who inhibit the learning of others, should not be tolerated”.
Sarkozy aimed one particular part of his speech at Roma, travelling people and immigrants, whose values and way of life were for him undesirable. He demagogically presented them as one of the main causes of the country’s economic and social problems, and threatened to withdraw their welfare benefits and expel them from their camps.
“We’ll examine the rights and welfare entitlements, currently available to foreigners living in suspiciously irregular circumstances. . . . The general rule is clear: illegals must be directed back to their own countries”, said Sarkozy. He had already asked the interior minister “to put an end to unauthorized gypsy settlements. These are lawless zones not to be tolerated in France.”
Sarkozy promised that the government would tear down all camps already declared illegal by the end of September. Where no such court ruling as yet applied, it would be instituted as soon as possible. Within three months, half of all Roma settlements are to disappear.
The French government thus plays its part in once again making scapegoats of Europe’s Roma population, who suffered so greatly under the Nazi persecution during the second world war.
According to the Le Monde newspaper, over 400,000 travelling people are registered in France. In 1990, some 95 percent of them were French citizens and only about a third followed a nomadic life. Roma from eastern Europe nowadays constitute a small minority of 15,000 to 20,000 people. Many from Romania, Bulgaria and other central European countries have come in the wake of the EU (European Union) project of eastern European enlargement.
Le Monde reported that more than 10,000 Roma had been expelled from France in 2009—8,000 of them to Romania—although they actually have the right as EU citizens to move freely within the whole of Europe.
Le Monde noted that, “Roma—some 90 percent of whom are settled—are still considered as undesirables in Europe, and are either corralled in shantytowns or deported. Last year, every fourth gypsy was either attacked, threatened or harassed.”
Nicolas Sarkozy’s attacks on Roma and immigrant families are part of a calculated policy of “divide and rule,” aiming to stir up a racist atmosphere. He wants to kindle primitive prejudices in order to shift the costs of the economic crisis onto the shoulders of the working class. He is simultaneously laying the foundations for a police state, a move that he justifies to the public as the “fight for domestic security”.
In doing so, Sarkozy is able to rely on the fact that neither the opposition parties nor the trade unions will threaten his course with any serious resistance. The law against the burqa, forbidding the wearing of whole body veils in public, was recently passed in parliament with only one dissenting vote—that of a UMP delegate. The whole of the so-called “opposition” either abstained or voted for the ban.

Qu'est-ce que votre cœur désire cher lecteur?
Ephèse 2:03 dit: «Parmi lesquels aussi nous avons tous eu notre conversation dans le passé dans les convoitises de notre chair, accomplissant les volontés de la chair et de l'esprit, et sont par nature des enfants de colère, comme les autres."
Vous savez, les convoitises de la chair sont manifestes, nous en tant que nation nous sommes consacrés à ces convoitises. De connaissances a été enlevé de la terre, à nos enfants, du peuple. Les dirigeants politiques et les chefs religieux de cette nation a conduit les gens égarés comme ils le faisaient dans l'ancien Israël.
Le coeur de beaucoup de nations sont corrompus et je crains que nous en tant que les gens vont faire face à la colère du Dieu vivant, si nous ne nous repentons.

An interview with Richard Brenneman, journalist who covered the Polanski trial
Swiss authorities announced July 12 that 76-year-old filmmaker Roman Polanski would not be extradited to the US. Polanski was arrested September 26, 2009 on his arrival in Zurich to attend a film festival. He remained under house arrest at his chalet in Gstaad until the Swiss justice ministry rendered its recent decision. The effort by the Los Angeles District Attorney’s office, assisted by the Obama administration’s Justice Department, to extradite Polanski in relation to charges of having sex with a teenage girl dating to the late 1970s, was a vindictive and politically motivated act.
An unsavory alliance of extreme right-wingers, feminists and liberal media pundits came together over the Polanski issue, demanding that “justice be done” once and for all in the case of this “rapist” and “pedophile.” Erstwhile “left” elements paid no attention to the facts of the case, including the systematic violation of Polanski’s rights by the judge in the case in 1977-78, or its social and political implications, so blinded are they by the prejudices of identity politics.
As we noted earlier in July, this sordid coalition “uses inflammatory, fake populist arguments as a means of whipping up the most backward layers of the American population with hot-button appeals to the ‘protection of children against predators.’ The targets of this lynch mob are ‘Hollywood types,’ artists, intellectuals and non-conformists of every variety. The anti-Polanski effort has undertones of xenophobia and anti-Semitism, along with old-fashioned American Puritanism.” Richard Brenneman is an author and veteran journalist, who covered the Polanski case for the Santa Monica [California] Evening Outlook. As the newspaper’s court reporter, he had a unique vantage point on the events and an unusual relationship with Judge Laurence J. Rittenband. Brenneman figures prominently in the 2008 documentary, Roman Polanski: Wanted and Desired, directed by Marina Zenovich. He has written numerous recent articles on the case.
Brenneman was kind enough to consent to a telephone interview. He spoke to us from his home in Berkeley, California.
David Walsh: Can you tell me how you got involved in coverage of the Roman Polanski case?
Richard Brenneman: I was hired by the Santa Monica Evening Outlook, a newspaper that no longer exists, to cover the courts and do special projects—investigative work, as it were. And the first case I covered was a murder case with connections to Chicago organized crime apparently. It was in the courtroom of a judge named Laurence Rittenband.
Rittenband was the senior judge on the Santa Monica court. When the Polanski case came to Santa Monica, he grabbed the case. Since I’d been covering trials in his courtroom for the previous several months, Rittenband basically appointed me the liaison to the out-of-town press that poured in for the case.
DW: What was your impression of the press corps? Were there especially disreputable elements?
RB: One tabloid, for example, offered me $25,000—a considerable sum of money in 1977—if I would give them the inside details on the young woman involved in the case, and help them set up an ambush photo of her.
DW: Did you have any encounters with Polanski himself?
RB: Not until many years later. Twenty years later, I spoke to him briefly, when I was thinking of writing a book about the case. He was very calm and very reasonable. We didn’t discuss the details of the case. We discussed more about how intense media coverage and sensationalism can influence the judicial process.
In 1977, from a distance, my initial sense of Polanski was of someone stunned by what had happened.
It was a perfect Hollywood case. You had someone who was a controversial figure, he had made some brilliant films, including Chinatown—which as the case went on I came to see as really a cinematic foreshadowing of what happened to him. He was Jewish, he was short, he was the victim of the most brutal mass murder cult California has seen, he was someone who was associated with all manner of rumors, especially once the case began.
DW: You can’t help but think that here was someone who was a prime target for scapegoating and the media frenzy.
RB: The fact that the case was grabbed by a judge such as Rittenband who was obsessed with celebrity, and who considered himself something of a celebrity, had the most profound impact on what came about.
The conduct of the district attorney’s office, to my mind, was exemplary. The individual who handled the case, Roger Gunson, is an extremely honest individual. The district attorney at the time, John Van de Kamp, was a reasonable person himself. Their interest was in seeing a resolution of the case. They wanted a conviction on the record, but when the victim let it be known that she would not under any circumstances provide any testimony in the case, they were faced with the necessity of arriving at a plea bargain.
Douglas Dalton, Polanski’s lawyer, had a reputation for being a superb negotiator, and his talent lay there. He was not a flamboyant attorney at all.
DW: One of the most fascinating aspects you deal with in your articles is the history and character of Judge Rittenband, a prominent figure in this whole affair.
RB: Judge Rittenband was a most impressive human being, but the man who was most impressed with Judge Rittenband was Judge Rittenband. In some ways, he was a classical figure. Like Polanski, he was short, he was Jewish, he was brilliant and he knew he was brilliant. He was fascinated with the darker side of life.
They were both celebrities. Rittenband was a celebrity at the Hillcrest Country Club, where he mingled with some of the wealthiest, most powerful and influential people in the country.
Polanski moved in exalted circles. They had some acquaintances in common, because some of the film industry people hung out at the club, as did the judge.
DW: What was the significance of the Hillcrest Country Club at the time?
RB: Back in the 1920s, the Los Angeles Country Club, the gathering place of the elite, would not take actors or Jews as members. Members of the wealthy Jewish population in Los Angeles decided to form their own country club, and Hillcrest was the result. Hillcrest was, and is, a gathering place of the elite. Memberships are inheritable, and legal battles have been fought over it. It is a place of privilege and power, where a lot of dealing goes on, just as at the L.A. Country Club.
Rittenband held court there. The club’s main dining room was for men only. When you walked into center of the dining room, there was a pillar. The judge’s table was at the pillar, in what I call the gunfighter’s seat. With his back to the pillar, he saw everyone who came into the room, everyone saw him. Everyone would walk by and pay tribute to him as they walked in. He had the power seat in the power institution.
His best friend, Sidney Korshak, was an attorney who never bothered to get his legal ticket in California, and who was identified by both the US and the California attorney general as the principal link between organized crime, business and labor politics in the US.
Korshak, from Chicago, had been sent out by the Capone organization as their representative in Los Angeles to the film industry. His closest ally in the industry was Lew Wasserman, the head of MCA Universal, the largest film producer and the largest producer of television in the world at the time. Wasserman had constant contact with Korshak. Wasserman was also Ronald Reagan’s agent back in his show business days. Both Reagan and Korshak were groomsmen at Frank Sinatra’s wedding.
DW: When you mention all these connections, it makes you wonder about the forces that wanted to see Polanski punished.
RB: The judge was not vindictive toward Polanski originally. If anything, he was somewhat sympathetic, or even cynical. His initial reaction, on hearing the details of the case, was ‘Oh, was this a mother-daughter hooker team?’
At the time, the judge was dating a woman who was 19 when they first met, he was now 70.
DW: According to your articles, Rittenband was complaining that he was getting phone calls pressuring him to be tougher on Polanski. Who was he getting phone calls from?
RB: The wives of his friends from Hillcrest. The whole thing spun out of control as the result of something I witnessed while waiting for breaks on the Polanski case. It was a rape case involving a 19-year-old schizophrenic girl. The woman was examined on the stand by the prosecutor, and when it came time for the defense to examine her, she went catatonic. She threw her arms across her chest and refused to respond.
Judge Rittenband asked her to testify, explaining that the law says it’s a fundamental right of the defendant to cross-examine any witnesses against him.
None of that was reaching her. After a couple of times of gentle prompting, Rittenband railed at her from the bench—it stunned everyone in the courtroom. And when she still refused to testify, he had his bailiff arrest her on contempt, and handcuff her, take her out of the courtroom. She was hauled off to jail. When she came back the next day, her face was covered with angry bruises, also stitches, I believe. On the jail bus, a bunch of black women had tried to talk to her, and when she didn’t answer, they took it as a sign of racial prejudice, and laid into her.
When she came back into the courtroom, everyone was stunned. She did manage to make it through her testimony. I wrote stories about it, both when she was arrested and when she came back with her injuries. This was precisely at the moment that the attorneys were hammering out the details of the plea agreement in the Polanski case. The agreement was reached on the same day that my story about the girl’s beating came out.
We were an afternoon paper, and so the paper didn’t arrive at the homes of Rittenband’s Hillcrest friends until after the decision had been reached. He got home after reaching the deal with Polanski, and he was deluged with phone calls. It was then that the judge called me into chambers, the next day, after getting all these calls, and he looked at me and said, ‘Dick, what the hell do I do with Polanski?’
He was asking me, as a reporter, basically what decision he could make that would play best in the press.
DW: This was not a rhetorical question.
RB: No, he called me into chambers, that was the clear indication of his intent. He wanted advice.
DW: How did you respond at that moment?
RB: I just remember leaning back and throwing my hands up, and saying, ‘Judge, that’s your decision, there’s nothing I can say.’ I was absolutely astounded. First of all, if he’d been smart, he could have conducted a roundabout conversation and gotten the information he’d wanted in the course of it. Just like any good interviewer. And I realized that if I told him something, he’d do it. It was the most stunning single encounter that I’ve ever had as a journalist with a figure in power.
His concern was not at all about justice, his sole concern was in saving face.
DW: The judge’s decision later to send Polanski to Chino State Prison for 90 days for the diagnostic analysis …
RB: That was illegal. A psychiatric diagnosis cannot be imposed as a sentence. In any case, there was no reason to send him to Chino. Two psychiatrists and the county’s most skilled probation officer all reached the conclusion that there was nothing about Polanski that mandated prison time whatsoever. They concluded that he was not a mentally disordered sex offender.
The only reason Rittenband sent him to Chino was so he could say, ‘I sent the son of a bitch to prison.’ It was absolutely blatant.
In any event, Polanski was released in January 1978, after 42 days. And there were more phone calls. What Rittenband is hearing from his pals at Hillcrest, or their wives, is, ‘You’ve got to send this guy to prison, 42 days is a farce.’
The judge at that point decided, ‘Well, it’s a 90-day diagnostic, so I’ll send him back for another 48 days.’ The problem is, it’s very questionable whether a judge can send anyone to state prison for 48 days. Anything less than a year is handled in the county jail. But Rittenband wanted prison, and the only reason Rittenband wanted prison was self-serving, his own reputation. Justice had nothing do with it.
DW: When did he decide to renege on the plea bargain?
RB: What I think happened is that after Polanski got out … and I would defy anyone to spend 42 days in Chino and think it was not punishment. Regardless of that, the 90 day figure was out there, which is the maximum under law for this process. Forty-two days was not an unusual period of time for one of these evaluations.
The judge knew that. My perception was that the figure of 90 days got taken up by his friends, and they all presumed that Polanski would be doing three months in prison. And when it turned out to be less than a month and a half, this is informed speculation, the judge was confronted with ‘90 days isn’t much, and you didn’t even give him that!’
So Rittenband at that point completely lost it. You have to remember that this judge was a raging egomaniac. He had his bailiff keep leather-bound volumes of all the clippings about his cases, which he would have the bailiff show to reporters who asked about him. I have never seen that.
Here was the judge for the first time getting bad press in his career. He had lost high-profile cases in the past, Elvis Presley, Cary Grant, Marlon Brando, on and on. Here he was getting the negative feedback and he was desperate to save face.
What I think happened, and the reason Polanski fled, was this: Rittenband played tennis every day at the Hillcrest. One day after tennis, in mid-December 1977, Rittenband went into the shower room and producer Howard Koch was there and he overheard Rittenband tell someone ‘I’m going to give him the maximum.’ My sense is that Koch misunderstood what he meant. I think the judge meant to say, I’ll give him all the 90 days, the maximum for the diagnostic process. Koch interpreted it as the maximum for the crime pled to, at least a couple of years in state prison, if not more.
Even Roger Gunson, in the documentary Wanted and Desired, acknowledges that he couldn’t be sure what the judge would do. So no one knew what the judge would do, and Polanski, having fulfilled every aspect of the plea agreement—including having done the prison time specified in the plea bargain—took it upon himself to flee, and, honestly, had I been in the same situation, with the resources that Polanski had, I probably would have left the country too. Because the judge was crazy.
DW: What was your reaction when Polanski was arrested in Switzerland last September?
RB: Let’s go back first to when I found out that the judge died. He died in 1993, but I didn’t find out about it until three years later. The moment that I found out, I sat down and wrote out an affidavit, and sent it to Doug Dalton, Polanski's attorney, telling him that the judge had called me into chambers and that I considered this improper conduct, and that if it ever became necessary, I would be glad to testify.
I wrote the letter then because I had an agreement with the judge that anything we discussed in chambers I would not divulge. The judge would give me background, would explain points of law to me, because I had never covered the courts before—so he was a source. When I learned the judge had died, the agreement was terminated, and since I had facts that might determine the outcome of the case, I was morally obligated to come forward and say what I knew.
So when Polanski was arrested, my first response was, ‘Oh, shit, this is all going to be coming up again.’ The fact that he was arrested in Switzerland surprised me, because I knew he had been visiting there for years. When the arrest broke, my immediate assumption was that I might find myself in play in this again, as a witness this time.
I thought: why the hell is the L.A. district attorney bringing this up again? My conclusion was that they had been so embarrassed by the documentary, Wanted and Desired, in which I told my story and which raised the case in a manner in which I was glad to see it raised.
Why the hell don’t they just leave this alone?
I think this has to do with the political ambitions of the Los Angeles district attorney, Steve Cooley, as well. Here he is, wanting to become state attorney general, and here he can …
A big difference in context between the time of the original case and the present day is that the Polanski case was kind of the final act in the death of the 1960s. There was a much different attitude toward sex in those days. There was no HIV. In the years since there has been this whole hysteria about ‘sex abuse cults’ of children; we’ve become extremely sensitized to child sexuality and exploitation, never mind that the biggest culprits in this are the media anyway.
When Polanski was arrested again, it was a perfect vehicle for pushing a whole bunch of politically sensitive hot buttons with the Republican base, sexual abuse of children, European decadence, Hollywood decadence, society corruption. It was a perfect way for the DA to get his name in the press in ways that would give him favorable coverage.
DW: One of the nails in the coffin of the extradition process was the refusal of the California authorities to provide the Swiss with the transcript of testimony Roger Gunson provided this past winter.
RB: Everyone knows the content of his testimony, he speaks about it in the documentary. He would have made a case for judicial misconduct. The district attorney’s office doesn’t want it officially known that it broke an agreement into which it had entered with Polanski. But the superior court system has no interest in seeing those transcripts either. They didn’t want the revelation that one of their most esteemed judges, one of their highest profile judges, had been corrupt.
A lot of people are happy that it played out this way, without the facts about the misconduct and corruption coming out.
I have a larger question.
At the time the case happened in 1977, I didn’t realize who Sid Korshak was. I had had lunch with the man Rittenband introduced as ‘My friend Sidney’ at the Hillcrest. But I didn’t know who Sidney Korshak was. I simply noticed that when the three of us were having lunch at the judge’s table, that all eyes in the room at one point or another were on us. I had the definite feeling that I was part of something significant and that I hadn’t the faintest notion what it was.
In addition to his celebrity trials, Judge Rittenband did all the law and motion work for the Santa Monica courthouse. That is, when a case before any of the judges in the courthouse needed a legal reading on it, or if there was a motion to be considered, Rittenband was the one who made the decision, and those decisions can often effectively determine the outcome of a case, one way or another. If a judge decides a case has been brought improperly, or whatever, the case is thrown out. Or a ruling could buttress a case.
The judge was in a position of tremendous power. Every Friday morning he held law and motion calendar in his room. Typically, he would start out with a pile beside him two feet high, and people would come in and argue their motions.
Bear in mind his association with Korshak, and Korshak’s position of power, which was phenomenal. Rittenband with a single decision could torpedo or buttress a case. This raises a legitimate question, was he the mob’s fixer? I don’t know the answer.
The Santa Monica courthouse covered all of Westwood, Beverly Hills, Bel Air, Brentwood, Malibu, Century City, where the majority of the town’s well-off lawyers had or still have their offices. No judge was in a position of greater power in the nation’s largest substate judicial system. Who knows what the judge was doing? I don’t, but I have every reason to suspect that not everything was on the up and up.
If we had a strong press corps in this country, and since the time of the Polanski case, the press corps has been gutted, reporters would go into and take a look at the judge’s decisions. Is there someone else today who’s fulfilling that same role? I don’t know. We won’t know, because the nation’s press corps has been tamed

Like Hister over Stalingrad, they will never end this contest as long as they have support from other nations, they will never entertain peace. This contest will result in either the conplete destruction of the U.S. or like Vietnam.
Your sanctions against Iran are unjust. There is no basis for them other than the sick, paranoid delusions of a cowardly U.S. and its cowardly paranoid people. Like North Korea, if Iran truly wants nuclear arms, the war will spread and require greater number of troops. North Korea spat in the face of the U.S. because they know that there is no more courage in their veins, and after their humilating defeat in the 70's and their humiliating defeat for the past 8 years, there is no way the U.S. can engage in another war with another nation.
China should have intervened recently with the incident that remains classified regarding North Korea. I see no logical reason why Iran should be penalized. Save for the McCarthy attitude of the U.S. regarding Islam. The man has attended UN summits, he has stated his OPINION before all the world. He has no secrets, he has been honorable and forthright which is more than I can say about the U.S. and its western allies. All I see, is fear and warmongering. He has a right to defend his nation and by your human standards, nuclear weapons are deterants for war. North Korea has the bomb, and they have not committed any unusual acts of aggression despite the propaganda of the U.S. State Department. The U.S. Navy has no right entering their oceans, seas, or territory. That is a provocation, and that is all they seem to be doing regarding Iran.
I think the French are fools to entertain these sanctions against Iran, because all you will do is give more cause for war and it demonstrates the ineffectiveness of the U.N. Why should Iran cooperate with the U.N., he has done so, and your evidence for the sanctions is at best, cicumstantial. Your greedy ally, the U.S. is going to get you into a world of shit and I promises you that once you go down this path there is no turning back. They live in a delusion, they are cowards and fear all. Like Hister, they seek to take one nation at a time, justifying it "everybody that is Muslim is a terrorist". I pray that you will seek out wisdom and peace.
Iran has made it no secret that they desire nuclear arms to protect and defend their nation. All you are doing is demonstrating that the U.N. is corrupt, I thought it was an organization to prevent wars, all it seems to Michael the Archangel is an organization that penalizes those whom wish to advance themselves. Iran's nuclear program has both military and civilians goals in mind. That is their right as a nation. Recent reports submitted to the U.N. state and can be substantiated with FACTS that Iran does not support terrorism in or from Iran. They remain neutral, as should any intelligent nation that does not share the views of a western nation controlled by fear and prejudice.
If anything, the U.N. should welcome Iran and should allow Iran to pursue its nuclear ambitions. They have been pretty good about sharing the facts of their progress and intentions, even allowing the media to observe their facilities. I am interested in this: Why is the U.S. so frightened of Iran? This is bullshit what you are doing to the people of Iran. There will be a penalty for this, whether by the hands of man, or natural disaster. The latter is most likely true. Iceland did not get your attention, we shall escalate the next natural disaster, we shall break you.
